我国已经在全国范围内建立不动产统一登记制度。不动产登记公信力,并非由登记这一公示方式本身产生,亦与登记之形成力、推定力没有必然的逻辑联系。物权行为理论采纳与否,同样不能决定登记公信力。善意取得制度亦无替代登记公信力之功能。不动产登记公信力之有无完全是立法政策选择的结果。我国《物权法》应当开宗明义地赋予不动产登记以公信力,并以不动产登记实质审查制度和错误登记国家赔偿制度为其制度基础。

The unified real right registration of immovable property has been established in China recently. The credibility of im- movable property registration is neither determined by registration - oriented publicity, nor necessarily has logical connection to factors that have played a role in propelling and forming the registration system. Similarly, registration credibility does not depend on whether ownership behavior theory has been adopted or not. Besides, bona fide acquisition system can＇ t replace the registra- tion credibility, either. The credibility degree of immovable property registration depends completely on legislative policy choice. From the very beginning, Chinese Property Law should vest credibility to immovable property registration, and establish and im- prove immovable -property- registration substantive examination and state compensation system.
