刑法中帮助行为的结构是帮助一方行为与被帮助一方行为组成的内在搭配关系,双方行为的性质与类型决定了刑法中帮助行为的成立范围。德日刑法共犯理论引申出的帮助行为的“从属式”与“独立式”结构存在局限,需要重构。刑法中帮助行为结构应具备法益侵害的本质特征、促进与必备的搭配关系、多元行为类型的组合模式。《刑法》总则与分则应就不同结构特征的帮助行为做出相应设置,以完备规制帮助型犯罪的刑事法网。

The structure of aiding behavior in Criminal Law is the relationship between The aided behavior and the opposite one, the scope of aiding behavior is determined by both behavior＇ s nature and type. The accomplice and independent structure is orig- inated from German and Japan Criminal Law theory in complicity aspects, it is needed of rebuilt. The scientific structure of aiding behavior shall have essence for infringing of legal interests, have relationship of promotion and necessity, have models of varieties behavior. The general and specific rules of Criminal Law shall adapt to the different types of aiding behavior, to benefit for the evaluation of aiding Crime.
