专属经济区内的外国军事活动是否属于1982年《联合国海洋法公约》第87条规定的专属经济区航行飞越自由,或与这些自由有关的海洋其他国际合法用途？沿海国是否有权规制其专属经济区内的外国军事活动？《公约》并未明确禁止外国在沿海国专属经济区的军事活动,但《公约》中和平利用海洋等规定表明外国军事活动并非绝对的自由;海洋安全形势的变化也对条约解释提出了新的要求;有关国家实践更为条约解释及习惯国际法的产生提供了基础。中国在专属经济区内对外国军事活动进行规制,同时在外国专属经济区内有限度地从事军事活动,这一最新实践顺应了国际海洋法的发展趋势。

Are the foreign military activities in the coastal states＇ EEZ（ Exclusive Economic Zone） part of the freedoms of navigation and overflight as referred to in UNCLOS Article 87,or at least part of the other internationally lawful uses of the sea related to these freedoms？ The foreign military activities in the coastal states＇ EEZ are not explicitly prohibited,while the UNCLOS provisions on the peaceful uses of the sea indicate that foreign states do not possess absolute freedom to take military activities in the coastal states＇ EEZ. Furthermore,the change of states＇ practice could strongly justify flexible treaty interpretation and the formation of new customary international law. China is regulating the foreign military activities in her EEZ,while taking limited military activities in foreign coastal states＇ EEZ at the meantime. This recent practice has conformed to the developing trend of international law of the sea.
