越南宪法明确规定军事检察机关是国家检察机关体系的组成部分,从根本上保证军事检察机关在国家政治生活中的地位。根据越南现行法律规定,军事检察机关按地域分级设立,在任务职权范围内具有一般监督权、调查权、公诉权、审判监督权和执行监督权等权能,并负担开展预防犯罪法制教育之义务。各级军事检察院实行检察长负责制,上级军事检察院检查、监督和领导下级军事检察院工作。军事检察人员的构成涵盖现役军人、国防员工或文职人员。无论是在权利行使上,还是在人员管理和职能保障方面,均具鲜明的独立特色。

the Vietnamese Constitution clearly stipulates that the military procuratorial organs are part of the system of the national prosecuting authority,to ensure the position of the military procuratorial organs in the country ＇s political life fundamentally. In accordance with the provisions of existing laws in Vietnam,the military procuratorial organs are set according to the regional classification,with general supervision power,right of investigation,prosecution,adjudication supervision power and execution supervision right power in the scope of authority and the task,to carry out the obligations of the legal burden of crime prevention education. The military procuratorates at all levels to implement the responsibility system of prosecutor,the superior military procuratorate check,supervise and lead the subordinate military procuratorate. Military prosecutors,defense staff covers active duty military or civilian personnel. Whether in the exercise of rights,or in the aspects of personnel management and the function of guarantee,independent features are distinctive.
