公正和效率是我国民事诉讼简易程序转普通程序的价值追求。但是，由于立法的滞后、空白、模糊、笼统，简转普在司法实践中出现较多问题。针对已出现的问题，比较我国台湾地区与德、日等国家有关简转普的立法，我们应当采取设计多元立法标准、赋予当事人程序选择权、规范转换程序，建立审查制度、增加有关转换程序效力之立法、填补因反诉简转普立法空白等措施。

Justice and efficiency is the value of the conversion of summary procedure into ordinary procedure. However, there are some problems in the conversion of summary procedure into ordinary procedure because of the blank, fuzzy and general legislation in judicial practice. In order to solve these problems, measures should be taken such as multiple legislation standard, option rights of civil procedures, specification conversion program, the effec- tiveness of the conversion program legislation, counterclaim legislation through introducing the legislation of Germa- ny, Japan, Taiwan and other countries and regions and comparing it with China.
