近年来,我国集体争议在数量和规模上都呈现上升态势,成为影响劳动关系和谐稳定的重要因素。与多数国家针对不同类型争议采取不同的机制和处理程序不同,我国劳动争议处理制度设计主要针对权利争议、个别争议,而对以停工、怠工为主要形式的集体争议,尤其是要求增加工资、改善劳动条件等集体协商争议尚未纳入现行法律调整的范围,导致实践中集体争议处理路径模糊、处理机构多变、处理方式不一。因此,健全畅通有序、公正及时的集体争议处理制度,建立从应急治标到长效治本的集体争议解决机制,是创新我国劳动关系协调机制的重要任务。

In recent years,collective dispute has displayed a rising trend in both number and scale,which has become an important factor affecting the harmony and stability of labor relations in China. However,unlike most countries that use different processing mechanisms for different types of disputes,the dispute resolution system in China is primarily designed for the right dispute and individual dispute. The collective dispute, which is mainly in the form of lockout and sabotage,especially for the collective bargaining dispute such as de-manding higher wages and better working conditions,has not been included in the scope of the current legal adjustment. Thus,the resolution path of collective dispute is vague,the resolution institution is volatile and the resolution approach is variable in practice. Improving smooth and orderly,fair and timely collective dispute resolution system and establishing collective dispute resolution mechanism from lash-up superficial so-lution to long-term fundamental solution are important tasks for innovating the coordination mechanism of la-bor relation.
