近年来小产权房问题得到社会的广泛关注,小产权房已经占据房地产市场一角.为找出小产权房建设的关键所在,为政府对小产权房的治理提供参考路径,利用博弈论构建政府、开发商、集体经济组织三方博弈模型,试图从内部因素分析小产权房形成原因.研究发现,博弈三方在比较利益驱动下,经过反复博弈,最终的混合纳什均衡是政府禁止小产权房建设,而集体经济组织和开发商是倾向于支持建设小产权房.得出结论:提高集体土地征地补偿标准,完善农村社会保障制度,更多地赋予集体经济组织和农民参与土地增值的分配权力,建立统一的城乡土地市场,规范农村经营性集体建设用地合法流转,让农民真正享有土地的权利是根治小产权房的解决之道.

The issue of limited property right house has obtained the society's widespread attention in recent years,limited property right house has become an important complement for the real estate market.In order to find out the key of construction of limited property right house and provide government with reference path for limited property right house governance,this paper uses the game theory to construct trilateral game model includes government,developers,collective economic organization and try to analyze the cases related to the forming of limited property right house from internal factors.The results indicate that:driven by the respective comparative advantages, government prohibits the construction of limited property right house,while developer and collective economic organization tend to support and build limited property house after repeated games-a mixed strategy Nash equilibrium.It is concluded that solution to limited property right house:increase the land compensation standards of collective land;improve the rural social security system;give more right distribution of land increment to collective economic organization and farmers;establish unified urban and rural land market;operate in land transfer of rural collective construction.
