通过分析农村土地承包经营权抵押法律禁止土地承包经营权抵押的成因,提出在当前形势下允许农民的土地承包经营权抵押既是合乎法理的,也是对现实需求的回应,因此需要从明确土地承包经营权抵押的标的物、重构土地权能,建立配套措施三方面来构建土地承包经营权的法律制度体系。
通過分析農村土地承包經營權牴押法律禁止土地承包經營權牴押的成因,提齣在噹前形勢下允許農民的土地承包經營權牴押既是閤乎法理的,也是對現實需求的迴應,因此需要從明確土地承包經營權牴押的標的物、重構土地權能,建立配套措施三方麵來構建土地承包經營權的法律製度體繫。

At present, to some extent, Chinese Legal system denies the integrity of land contract management property right and restricts the exertion of land mortgage function.By analysis the cause of legal prohibition, this article proposes that admission of mortgage of land contract management right is reasonable and in accord with reality.At last, proposal is offered to build the legal system involving clarifying mortgage object , reconstruction land function and improving supporting measures.
