自生态补偿概念提出以来, 我国学界和实务界对其内涵尚无定论. 矿产资源开发生态补偿, 是指在矿产资源开发利用过程中, 由矿产资源开发利用者或通过他人保护矿山生态环境行为致使自身生态利益增进者向特定生态利益受损者予以合理之补偿. 迄今为止, 我国矿产资源开发生态补偿法律规范体系已基本成型, 但其结构性缺陷制约了生态补偿制度功效的实现. 在分析现行法律规范体系及其存在问题的基础上, 尝试根据矿产资源开发生态补偿法律关系的综合性建构具有整体目的性、层次功能性和综合调整性的矿产资源开发生态补偿法律规范系统.

Since the concept of eco-compensation has been proposed, both academics and practitioners are uncertain about its implication. This paper argues that the eco-compensation institution of acquring mineral resources means that people who utilize the mineral resourses or conseve the mine eco-environment must pay for the people whose ec-ological benefits decreased because of these utilization. So far though Chinese eco-compensation institution of acqur-ing mineral resources has already fomulized, still there are some structural defects. We analysed the problems of this instution, and tried to construct legal norm system of eco-compensation of mineral resources.
