TRIPS协议例外条款不同于GATT1994和GATS中的例外条款，也不是所有限制知识产权专有性的条款，而是指具有无偿性、无期限性和无地域性共同特征的第13条著作权例外、第17条商标权例外、第26条第2款工业保护例外和第30条专利权例外。我国《著作权法》第22条和《专利法》第69条规定了著作权例外和专利权例外，但《商标法》并没有规定与TRIPS协议第17条相对应的商标权例外条款。

Different from the exception clauses of the GATT1994 and the GATS, the exception clauses of the TRIPS Agreement do not include all clauses of the TRIPS Agreement.Rather, they refer to Article 13 of copyright exception, Article 17 of trade-mark exception, Article 26 (2) of industrial design protection exception and Article 30 of patent right exception.These exception clauses share the common features of free and unlimited duration, as well as indefinite regions.Article 22 of Chinese Copyright Law provides for copyright exception, and Article 69 of Chinese Patent Law provides for patent right exception, but Chinese Trademark Law does not provide for trademark exception, corresponding to Article 17 of TRIPS Agreement.
