水是生命之源，是生命赖以存活所必须的物质。随着人口的迅速增长，工业的持续发展，人类对水的需要越来越多，对水的污染也越来越严重。然而，我国刑法对人们赖以生存的饮用水污染防治却是空白的，刑法作为具有重大威慑力，具有刚性强制力的保障法应该发挥其应在饮用水污染防治上的独特作用。水污染行为的严重社会危害性决定了将其规定为犯罪的必要性。将水污染行为予以犯罪化是必然趋势。

Water is the source of life and the matter for the survival of living creatures .With rapid growth in population and increasing development of industries , human beings'demand for water becomes greater and water pollution gets more and more serious .However , it is still vacant in China's Criminal Law as to the regulations of water pollution .Criminal Law shall exercise its special function as a threatening , forceful law guarantee to prevent drinking water pollution .The severe social harmfulness of water pollution calls for the necessity of taking water pol-luting activities as criminal acts .It is the ultimate trend to take water polluting acts as criminal acts .
