长期以来，“同案不同判”现象普遍存在于我国司法实践的各个领域，不仅严重破坏了我国司法权的统一适用，而且给我国司法公平公正造成了巨大的危害。这一现象具有我国成文法法律体系结构、裁判主体的主观方面和“同质化”程度以及司法程序运行过程中存在的缺陷等方面的形成原因。为了抑制该现象的发生，我国既要做到进一步细化立法技术、加大案件审判过程的公开力度，又要加强裁判主体的“同质化”和“去行政化”建设，更重要的是，要在全国范围内加快落实案例指导制度和全面推进量刑建议制度的建设。

For a long time, it is a common phenomenon that different judgments are adopted for similar cases in the various fields of judicial practice in China, which not only seriously damages the unified application of judicial power in China, but also does great harm to China’s judicial justice. Reasons behind this phenomenon may include the legal system of our statute law, the subjective aspect and the “homogeneity” degree of the judge, the defects in the judicial operation process and so on. In order to solve this phenomenon, we should take several measures such as further refinement of legislation, increasing the openness of the trial process, strengthening the“homogeneity” and “de-administrative” construction of the judge. The most important point is to fully implement the case guiding system and promote the sentencing suggestion system construction in the whole country.
