当下，我国还存在公共文化服务供应不足和失衡的现象。公共文化服务法律体系是供应充足和均等的制度保障。论文通过实证方法总结公共文化服务体系建设中的问题，从政府失灵角度分析成因，指出完善法律体系，克服失灵的途径。文章认为，因为决策制度、监督制度和评估制度的缺失，公共文化服务建设决策不合理，执行效率低下，建设目标模糊。因此，需要建立完善的公共文化服务法律体系。目前我国缺乏专门立法，效力层级较低，有效规则不足，必要制度缺失。因此需要推动中央和地方公共文化服务立法，补充原则、权利、主体、决策、评估和责任等核心制度。

There still exists the phenomenon of supply shortage and imbalance of public cultural service in China. The legal system of public cultural service is the guarantee of the adequate and equal supply. In this paper the author summarizes the problems in the construction of public cultural service system through empirical methods, analyzes the causes from the perspective of government failure, and points out the ways to improve the legal system and overcome the failure. The author thinks, because of the lack of decision-making system, supervision system and evaluation system, the public cultural service construction decision-making is unreasonable, the implementation efficiency is low and the construction target is fuzzy. Therefore, we need to establish a sound legal system of public cultural services. At present, many problems exist in our country, such as lack of the specialized legislation, low effective level, insufficient effective rule, and lack of essential system. Therefore, we need to promote the central and local public cultural service legislation and the core systems, including the supplementary principle, the right, the main body, the decision-making, the evaluation and the responsibility.
