近年来随着医疗科技的发展，各类新型医疗物品不断应用于医疗领域，这在极大程度上提高了人类健康水平，但伴随来也有医疗风险的增加。诸如因药品、消毒药剂、医疗器械缺陷或者输入不合格的血液造成患者损害的案件时有发生，这在一定程度上加重了医患关系的紧张。就医疗物品侵权责任而言，其是医疗损害责任的一种，不可否认的是它也具有产品责任的某些特性。本文将以《侵权责任法》第59条为中心，着重分析缺陷医疗物品致害责任的构成要件以及责任承担。

In recent years, with the development of medical science and technology, all kinds of new medical items constantly applied in medical field, improve the level of human health, but also increase the medical risks. Such as for medicines, disinfectants and medical equipment defect or enter unqualified patients blood damage cases have occurred, this to a certain extent, increased the doctor-patient relationship nervous. In terms of medical tort liability items, it is one of the medical liability for damage, there is no denying that it also has some characteristics of the product liability. In this paper, refer to the tort liability law article 59, emphatically analyzed the components of the responsibility for damage caused by the defect of medical items and responsibility.
