以2015年2月6日新疆阿勒泰地区的一位牧民捡拾到的一块7.85公斤的“狗头金”的所有权归属为例，对无主物适用先占制度的合理性进行阐释说明，确定无主物的物权法律关系；由此可对各国无主物先占制度的规定及合理性进行阐释说明，并对构建我国无主物先占制度提出设想。

On February 6th 2015, a herdsman in Altay of Xinjiang Province picked up a gold nugget of 7. 85 kg, whose own-ership aroused the public’ s attention. This paper starts by analyzing the nature of the nugget, and then defines its property as ownerless goods. It further connects the case to the stipulation of preoccupying ownerless goods in other countries, and elaborates on the rationality that preoccupation principle applies to ownerless goods, thus confirms the property legal relationship of ownerless goods. The paper finally proposes some idea for the establishment of ownerless goods in China.
