我国立法确定了“避风港”原则以解决网络服务提供商所提供服务涉及的作品侵犯著作权人合法权益时是否需要承担责任的问题。然而这一原则在适用上还存在由于界定不清晰而误解、滥用的情形。本文将结合搜狐诉今日头条一案浅谈“避风港”原则的适用问题。
