对虚构保险标的中“虚构”和“保险标的”进行了阐释，对于以下五种特殊虚构保险标的行为进行了刑法学分析：隐瞒型投保应区分隐瞒健康状况和隐瞒年龄状况；重复型投保应注意虚构的是后一保险标的；超额型投保应注意保险诈骗的数额认定仅包括超额部分；事后型投保时间参考线应为投保时；变更型投保不构成保险诈骗罪，应以普通诈骗罪论处。提出保险诈骗罪中的虚构保险标的的主观方面只能是直接故意，而不可能是间接故意。

T he phrases "making up" and "object of insurance" in making up object of insurance are ex‐plained .The following five types of making up are analyzed from the view of criminal law :for the hiding type insurance ,the concealing of health and age should be distinguished;for the repetitive type insurance ,it should be the object in the latter insurance that is making up;for the over‐amount type insurance ,the a‐mount of insurance fraud should only include the excess amount ,not including non‐excess part ;for the after‐the‐event type insurance , the reference time line should be defined as the initial insurance time;and the change‐type insurance does not constitute insurance fraud and should be punished as the general crime of fraud .The subjective aspect of making up object of insurance in insurance fraud can only be direct intent not indirect intent .
