刑事错案问题一直是社会关注的热点,文章主要指出刑事司法改革的困难之处. 这些困难是由影响法院处理刑事错案的防范和纠正错案的司法制度缺陷造成的.通过案例研究分析了刑事诉讼法2012年修改前后防范和纠正错判机制的缺陷,并指出司法改革失败的原因不在于中国的文化习俗、价值取向,而在于司法体制问题.应该正确定位公检法三家关系,提高法院的独立性和审判的透明性,以更好地防范错判,纠正司法执行中的突出问题.

People have been long focusing on the wrongful criminal convictions. This article expounds the difficulties involved in the implementation criminal justice reforms. These difficulties are caused by deep flaws that affect court responds to wrongful convictions and dampen the prospect for their prevention or remedy. Through new case studies,it critically examines the difficulties associated with the implementation of mechanisms for preventing or remedying such convictions. It further analyzes deep flaws in China's judicial system,indicating that the major reasons for the constant failure of judicial reforms is due more to institutional practices than to cultural practices and value orientation in China. It concludes that the relationship of courts,police and prosecutors should be properly positioned and corrected to improve the independence of the courts and judicial transparency so that the wrongful convictions will be prevented,and the major flaws be mended to fill the implementation gap between law and practice.
