关于国际投资仲裁中的书证出示，《ICSID 公约》《ICSID 仲裁规则》等相关规则缺乏具体的规定。通过对国际投资仲裁实践的考察得知，书证出示的范围与条件已形成了具有一定共识的标准和规则，而对于书证的特免权保护，寻求普遍接受的规则成为解决这一问题的优先方法。如果持有书证的当事人拒绝出示书证，仲裁庭可以自行或依申请采取不利推定、仲裁费用分配等救济方法。

As for the issue of document production in international investment arbitration,the ICSID Con-vention and ICSID Arbitration Rules have no detailed provisions.Through the survey of the international invest-ment arbitration,the standards and rules on scope and requirements of document production have been estab-lished.As for the protection of exemption right on document,to seek the widely accepted rule is the preferred method.If the parties refuse to produce the documents within their control,the tribunal at the request or on its own motion may adopt the remedies by themselves or by approved application such as adverse inference,distri-bution of arbitration cost.
