费孝通先生用吉尔兹"深度描绘"的方法对乡土中国的场景进行了刻画,并给予了同情式的理解.中国正在从个人魅力型统治、传统型统治的礼俗社会向法理型社会转型.法律视野下乡土社会意蕴的异化是转型的前提,礼俗社会和法理型社会是转型的两个面向而且具有较大的差异.基于礼俗社会的缺陷,群育观念、规则信任的培育可以打破路径依赖;法秩序的变通观照可以看清法秩序在乡土社会的消解形态;提出一种"新权力",即过渡时期新权威主义再型构.同时也对转型的思维困境——历时性问题共时性解决,给予了观照.

Customs society in China is from the traditional rule, from charismatic rule to legal society transformation. The alienation view of law domain of rural society is the premise of meaning transformation. Gemeinschaft and legal society are two for transformation and have big differences. Based on the defect Gemeinschaft, cultivation of the so?cial education and rules of trust can break the path dependence; flexible reflection law and order can see the law and order in rural society digestion form, propose a"new power", namely the transition period new authoritarianism and structure. Also solving the transformation of thinking predicament-a diachronic synchronic problem gives the observation.
