环境犯罪与传统犯罪相比具有特殊性，因而仅仅运用自由刑和罚金刑无法满足司法实践的需要。修复性环境刑罚能够破解环境犯罪执行难的问题，并且满足被害人的权利需求，同时又兼顾预防环境犯罪，为犯罪人提供自我救赎的机会。建构修复性刑罚应当完善罚金刑并增加责令补救和公益劳动刑罚措施。此外，合理设置资格刑也是修复性环境刑罚的重要内容。

Compared with traditional crime , environmental crime has some specific features and only the use of criminal penal -ties can not meet the needs of judicial practice .Restorative environmental penalty can crack the difficulty of environmental crime ex -ecution and the needs of victims'rights, while taking into account the prevention of environmental crime , providing an opportunity to redeem themselves for the perpetrators .Improving the punishment and increasing ordered remedy and volunteer labor punishment can construct the reparative punishment .In addition, a reasonable set qualifications punishment is an important part of repair envi -ronmental penalties .
