知识产权问题一直是我国近年来的热点问题,2015年政府工作报告中多次提及知识产权保护的相关问题,强调深入实施知识产权战略行动计划,加强知识产权保护和运用,打击各种侵权行为,发展创新,保护创造。中医药知识是中华民族通过几千年医疗实践积累的宝贵经验,但是现有的关于中医药知识产权保护的相关法律和政策不能完全与中医药知识产权保护现存的问题相适应,缺失对中医药知识产权的明确保护,导致中医药知识和研究成果的流失,丧失其独有的优势和价值。本文通过对我国中医药知识产权保护方面现存的问题分析,并提出建议,以期我国中医药知识产权保护的发展。

Intellectual Property Issues has been a hot issue in China in recent years, issues related to the 2015 government work report mentioned several intellectual property protection, emphasiZing in-depth implementation of intellectual property strategic action plan to strengthen intellectual property protection and use, to combat all tort, development and innovation, the protection of creation. Chinese medicine knowledge is valuable experience of the Chinese nation for thousands of years by the accumulation of medical practice, but the existing laws and policies on intellectual property protection of traditional Chinese medicine and Chinese medicine can not be fully protected by intellectual property rights to adapt the existing problems, the lack of Chinese medicine clear protection of intellectual property rights, result in the loss of medical knowledge and research results, the loss of its unique advantages and value. To China in terms of Intellectual Property in the existing problems, and put forward recommendations to the development of pharmaceutical intellectual property protection of the paper.
