我国刑事法庭早在西周奴隶制社会时期就已初具雏形，后经过秦朝直至清朝的封建制社会时期的发展，逐渐形成了“n”字形的刑事法庭布局，民国时期的刑事法庭布局则具有较为明显的党性特色。新中国成立后，我国的刑事法庭布局基本上是以“伞”状结构为基础模型发展起来的。我国刑事法庭的历史嬗变至今，存在着静态布局和动态布局两个方面的掣肘问题。究其原因，有历史文化传统的影响、审判模式理论与现实的不适应、案卷中心主义的阻却以及控辩双方力量对比的失衡等原因。当下有必要调整控、辩、审三方力量的配比并建构“等腰三角形”式的新型刑事法庭布局。

As early as in the slave society of Western Zhou dynasty Chinese Criminal Tribunal had shape , which ,after a period of Qin dynasty to the Qing feudal society development ,gradually formed an “n”shaped layout of the Criminal Court . Layout of criminal courts in the Republic of China has the more obvious characteristics of party spirit .After the founding of new China ,China’s Criminal Court layout develops by the model of “umbrella”‐like structure .In the history of our criminal courts ,there are two aspects :one is static layout and the other is dynamic layout .The reasons include historical and cultural traditions ,the trial pattern theory and reality not suit each other ,archives center block and the imbalance between prosecution and defence forces .It is necessary to adjust the proportion of prosecution debate and defence ,and establish the layout of the Criminal Court according to “isosceles triangle” now .
