儿童权利和利益的独立化是亲子权利冲突的逻辑前提。欧洲人权法院的司法实践表明，对于儿童最大利益原则的理解不应当绝对化。无论是家庭生活范畴的界定，还是对法律依据和其目的的审查，抑或是对民主社会之所需标准的判断，都必须将利益平衡原则作为基础。儿童利益只是利益平衡中所需要考虑的一项重要因素，并不会当然地处于权利位阶的上层。在具体的案件中，利益平衡原则提供了更为透明的司法推理，克服了儿童最大利益原则所面临的模糊性困境。
兒童權利和利益的獨立化是親子權利遲突的邏輯前提。歐洲人權法院的司法實踐錶明，對于兒童最大利益原則的理解不應噹絕對化。無論是傢庭生活範疇的界定，還是對法律依據和其目的的審查，抑或是對民主社會之所需標準的判斷，都必鬚將利益平衡原則作為基礎。兒童利益隻是利益平衡中所需要攷慮的一項重要因素，併不會噹然地處于權利位階的上層。在具體的案件中，利益平衡原則提供瞭更為透明的司法推理，剋服瞭兒童最大利益原則所麵臨的模糊性睏境。

The independence of children’ s rights and interests constitutes the logic premise of confliction between children and parents.The case law of the European Court of Human Rights shows that the interpreta-tion and application of the best interests principle should not be absolute.No matter in the process of defining the conception of family life, reviewing the legal bases and their corresponding aims, or scrutinizing the neces-sity of democratic society, the balancing exercise is of crucial importance.Children’ s interests are just only one of the factors that should be taken into account.That’ s to say, its priority is not automatic.In given ca-ses, the balance of interests principle offers a much more transparent reasoning and averts the vagueness prob-lem enshrined in the welfare principle.
