目前司法解释将抢劫毒品行为认定为抢劫罪，不如刑法将其独立成罪；司法部门以当地毒品非法交易价格确定抢劫数额，不如根据毒品数量对应不同等级的法定刑；参照抢劫罪加重法定刑等级，多次抢劫毒品行为应当成为升格法定刑的条件。犯罪形态如何，并不影响法定刑升格条件的犯罪次数认定。抢劫毒品多次与毒品数量竞合的，适用处罚较重的情节，抢劫既遂与抢劫未遂的数额不能累计计算，不同毒品种类累计可予依法折算。
目前司法解釋將搶劫毒品行為認定為搶劫罪，不如刑法將其獨立成罪；司法部門以噹地毒品非法交易價格確定搶劫數額，不如根據毒品數量對應不同等級的法定刑；參照搶劫罪加重法定刑等級，多次搶劫毒品行為應噹成為升格法定刑的條件。犯罪形態如何，併不影響法定刑升格條件的犯罪次數認定。搶劫毒品多次與毒品數量競閤的，適用處罰較重的情節，搶劫既遂與搶劫未遂的數額不能纍計計算，不同毒品種類纍計可予依法摺算。

Robbery drug behavior should be an independent crime into criminal law rather than as a robbery.The Justice Department should not determine the robbery drug price in accordance with local illegal transaction price now,different levels of legal should have punishment according to the quantity of drugs.According to aggravate the legal punishment grade robbery grade,repeated robbery drug be-havior should be upgraded to be the legally prescribed conditions.Attempted crime and preparation shape factors are not the punishment effect to upgrade conditions of criminal number identification. When there are some coincidences between the robbery drugs repeatedly and the quantity of drugs, punishment heavier should be applicable.Robbery and attempted robbery of the amount cannot be calculated accumulatively.Different varieties of drugs can be legally equivalent cumulative.
