简要阐述了施工合同的特点，归纳了其在建设项目管理中的作用，为了规避合同履行时的风险，提出要从施工合同签订过程中加强工程建设的风险控制，结合工程实例，通过对合同文本中主要条款的签订要点进行分析，从发包人的角度介绍了施工合同签订过程中规避争议的有效方法。

This paper easily illuminates the characteristics of construction contract and summarizes the effect of construction contract in proiect management. We should strengthen risk control from construction contract signing process to avoid the risk of performing contract. Combining with the proiect case and analyzing the sign key points in main terms of contract. This paper mainly introduces the effective ways of avoiding disputes in the construction contract form the employer’s point of view.
