离婚率的不断攀升影响了两岸婚姻家庭生活的和谐与稳定。两岸政治制度的差异及台湾地区当局的歧视性政策，致使大陆女性配偶离婚后，在台的居留权和定居权被剥夺；两岸诉讼离婚制度的差异，导致从事家务劳动的大陆女性配偶在婚姻关系存续期间无法获得“自由处分金”，在诉讼离婚中难以主张离婚后的“赡养费给付”及对子女监护权和会面权，大陆女性配偶身份权益得不到我国法律与台湾地区法律制度的有效保护。比较两岸诉讼离婚制度，阐述制度差异对大陆女性配偶身份权益的影响，提出我国法院审理两岸婚姻的离婚案件，应当在不违背我国婚姻法基本原则之立法精神基础上，适当参考台湾地区婚姻家庭法的相关规定，做出公正合理的裁判，切实维护离异后大陆女性配偶的身份权益。

The rising rate of divorce affects the harmony and stability of family life in Taiwan and mainland China. Differences in political and law suit systems as well as discriminatory policies in Taiwan deprive mainland female divorcees, who often struggle to access finances and, in case of litigation, advocate“alimony payments”or determine guardianship for children. Comparing cross-strait divorce litigation systems, explaining the impact of institutional differences upon the identity rights of mainland female spouses and proposing a cross-strait divorce case in a mainland court should be in line with the spirit of the Marriage Law of the mainland, with appropriate reference to Taiwanese regulations, to reach a fair and reasonable judgment, and ensure the rights of mainland women divorcees.
