环境侵权损害填补基金作为环境侵权损害赔偿社会化的具体制度之一，对于环境侵权损害填补起着十分重要的作用。在具体运作中，基金在资金来源、救济范围、启动标准（启动条件及救济方式）等方面存在诸多问题。基金的运作效果与基金的启动标准具有紧密联系，基金的启动标准又受到基金的资金来源及救济范围的限制。破解疑难问题需从基金的资金来源、基金救济范围和基金启动标准三个方面入手。

The compensation funds, as one of special bylaws of environmental tort damages socialization, plays an important role in the relief of environmental tort damage. However, in the process of operation, the funds have many problems in the capital source, the range of relief and the distribution standard, which includes the function of relief and supplement. The effectiveness of operation is closely linked to the distribution standard, which also be limited by the capital source and the range of relief. These difficult problems can be deal with from the points of the capital source, the scope of relief and the launch criteria.
