我国的行政审批制度改革,实质上是在发展市场经济的前提下政府的自我改革,改革中必然会面临困境,行政审批过程中目前面临诸多的困境:法律和现实的交锋———非行政许可审批概念的存在;政府与市场之间力量的较量———政府的越位、缺位和错位;政府和社会之间的纠结———第三部门的尴尬等。面对以上几种困境,我们借鉴日本和美国行政审批制度改革的经验,在《行政许可法》的基础上将非行政许可审批概念取消;加快政府职能的转型,在服务型政府之下审视当代政府和市场经济的关系;积极培育政府和市场之间的“润滑剂”———第三部门(中介组织和行业协会),逐步建立起政府依法监管、行业协会依法自律、中介机构依法执业的配套体制。

The reform of administrative examination and approval system in China is basically the government's self transformation in the premise of the development of market economy.The dilemma facing the administrative examination and approval is the confrontation between the law and reality, non administrative licensing examination and approval concept;between the government and the market power of contest, the offside, absence and disloca-tion of government;the tangle between the government and the society, the dilemma.of the third sector.In the face of these difficulties, we shall draw on the experience of Japan and the United States and conduct administra-tive examination and approval system reform in the following ways:Canceling non administrative licensing examina-tion and approval concept;Examining the relationship between contemporary government and market economy un-der the concept of service-oriented government;Actively cultivating“lubricant” between the government and the market -the third sector ( intermediary organizations and trade associations); Gradually establishing a govern-ment supervision mechanism according to the law, industry association in accordance with the law and self-disci-pline, intermediary institutions in accordance with the practice of supporting systems.
