在我国宪法关于基本权利的规范中，存在一个与“物质”相关的独立结构，要求国家提供一定程度的物质供给以保障基本权利的实现，可以统称为“物质保障”。作为基本权利的一种保障机制，“物质保障”强调了基本权利实现的条件，同时也强调了国家对于自由权的积极义务，因而具有积极意义。但是以“物质”为中心衍生的基本权利保障机制也存在局限性。因此，需要建构更为体系化的基本权利保障机制。本文提出以正当程序为表、以人格尊严为里，可以在整合“物质保障”的同时，形成更为完整且适宜的基本权利保障机制。

재아국헌법관우기본권리적규범중，존재일개여“물질”상관적독립결구，요구국가제공일정정도적물질공급이보장기본권리적실현，가이통칭위“물질보장”。작위기본권리적일충보장궤제，“물질보장”강조료기본권리실현적조건，동시야강조료국가대우자유권적적겁의무，인이구유적겁의의。단시이“물질”위중심연생적기본권리보장궤제야존재국한성。인차，수요건구경위체계화적기본권리보장궤제。본문제출이정당정서위표、이인격존엄위리，가이재정합“물질보장”적동시，형성경위완정차괄의적기본권리보장궤제。
There is a material-related independent structure in Chinese Constitution which requests state providing considerable material supply to the basic rights,and it could be called “material guarantee”.Particularly,it con-tains three levels:the first one is a principle that all the basic rights should be material guaranteed;the second one is a part of some basic right’s norm;and the third one is a basic right,the right to get material help.As a kind of basic right’s security mechanism,“material guarantee”has positive significance because it insists the conditions of basic rights,and the state’s positive duty to liberties.However,the basic right’s security mechanism which just fo-cuses on material also has shortages:firstly,the material guarantee in large part only has symbolic meaning;sec-ondly,the realization way of material guarantee is unclear;thirdly,the state intervention behind material guarantee could be bad for basic rights.So we need a more systematic basic right’s security mechanism.The mechanism which contains the due process as method and the human dignity as value goal could be more complete and proper.
