剥夺政治权利作为我国刑法中的一种资格刑，虽然适用范围比较广泛，但对犯罪未成年人来说，剥夺政治权利适用的法律规定并不是十分清晰明确。由于未成年人还不能完全享有刑法规定的政治权利的全部内容，致使对犯罪未成年人判处剥夺政治权利资格刑很有可能出现刑罚适用落空的问题。而且，从剥夺政治权利的内容来看，对犯罪未成年人适用剥夺政治权利其实是与宪法精神不相符合的。因此，应当取消对犯罪未成年人适用剥夺政治权利资格刑，并建构以预防为主的适用于犯罪未成年人的资格刑体系。
剝奪政治權利作為我國刑法中的一種資格刑，雖然適用範圍比較廣汎，但對犯罪未成年人來說，剝奪政治權利適用的法律規定併不是十分清晰明確。由于未成年人還不能完全享有刑法規定的政治權利的全部內容，緻使對犯罪未成年人判處剝奪政治權利資格刑很有可能齣現刑罰適用落空的問題。而且，從剝奪政治權利的內容來看，對犯罪未成年人適用剝奪政治權利其實是與憲法精神不相符閤的。因此，應噹取消對犯罪未成年人適用剝奪政治權利資格刑，併建構以預防為主的適用于犯罪未成年人的資格刑體繫。
박탈정치권리작위아국형법중적일충자격형，수연괄용범위비교엄범，단대범죄미성년인래설，박탈정치권리괄용적법률규정병불시십분청석명학。유우미성년인환불능완전향유형법규정적정치권리적전부내용，치사대범죄미성년인판처박탈정치권리자격형흔유가능출현형벌괄용락공적문제。이차，종박탈정치권리적내용래간，대범죄미성년인괄용박탈정치권리기실시여헌법정신불상부합적。인차，응당취소대범죄미성년인괄용박탈정치권리자격형，병건구이예방위주적괄용우범죄미성년인적자격형체계。
As a qualification penalty to the juvenile crime in our country,although the law provisions of the appli-cation scope of deprive political rights is more extensive,the rules of the deprivation of political rights for the juven-ile crime is not definite.Because the juvenile can’t enjoy all the rights of political rights in the criminal law,the deprivation of the political rights qualification penalty for the juvenile crime is difficult to apply.And from the per-spective of the content of the deprivation of political rights,it dose not consistent with the spirit of the constitution. Therefore,it is important to cancel the deprivation of political rights and construct the reasonable qualification pen-alty for the juvenile crime in order to prevent crime.
