清季以降,西医东渐速度日益加快,我国传统医师规范遭受西方近代医师规范的冲击,其内容发生新的变化.至民国时期,医师规范发展出现规范化、系统化的趋势,由道德规范、技术规范、法律规范等构成了近代医师规范体系,其中尤以法律规范表现更为直接、具体,更具有约束力.民国时期法律规范经历了由并行到统一的过程,其内容主要体现在资格认定规范、开业规范、义务规范、惩戒规范等四个方面.医师法律规范逐渐形成对规范医患行为、解决医患纠纷起到一定作用.

Since late Qing Dynasty, the pace of western medicine propagated to the east rapidly, and its content had changed greatly. In the Republic of China, doctor's standards appeared, composed by moral standard, technology standard and law standard, which consisted modern doctor's legal standard, especially in the legal standard with more direct, specific and more binding. In the Republic of China, legal standards had experienced from parallel to the unified process, its content mainly included qualification cognizance standards, occupational standards, obligatory standards and disciplinary standards. Doctor's legal standards played an important role in resolving disputes between doctors and patients.
