随着我国农村土地制度改革试点进入实施阶段,在积极探索农村集体经营性建设用地入市过程中,如何兼顾公平与效率成为改革的关键和突破口。在梳理典型国家或地区土地制度变革经验的同时,基于公平与效率角度总结提炼我国农村集体建设用地入市的主要模式,并从制度、法律、管理三方面剖析当前农村集体经营性建设用地入市的主要障碍,提出设置土地发展权、调节税收收益等一系列配套改革措施,通过引入电商理念,搭建新型土地交易平台,稳步推进我国农村集体经营性建设用地入市。

With China’s rural land system reform pilot stepped into the stage of implementation, how to united fairness and efficiency in exploring the united market of rural collective commercial construction land become the major problem.The paper combs land system reform experiences of typical countries or areas,and summarizes the main pattern of the united market of rural collective construction land based on fairness and efficiency angle.Then from aspects of the system,law, management to analyzes the main obstacles of the united market of rural collective construction land.Finally,put forward the optimization recommendations and countermeasures:setting up the land development rights,the tax revenue adjustment and a series of supporting reform measures, introducing the concept of“electronic commerce”and set up new land trading platform.
