对未成年罪犯施加刑罚，不仅是为了对其惩罚，更要注重体现刑罚的教育矫正功能。缓刑作为非监禁刑的一种，在对未成年犯的教育改造中有天然的优势。《刑法修正案（八）》对未成年犯的缓刑适用作出了一定改进，但是这些改进并不能满足缓刑制度对未成年犯刑罚适用的发展要求。通过对我国未成年犯缓刑适用予以考察，分析其中存在的现实问题及其原因，并从实体与程序方面提出具体的完善措施是其应有之义。

Penalties imposed on juvenile offenders,not just to punish them,but to focus on education reflects the punishment correction function.Probation as a non-custodial sentence,in education and reform of juvenile offenders has natural advantage.”Criminal Law Amendment” (eight) on juvenile delinquency probation made some improvements,but these improvements cannot meet the development requirements of the probation system for juvenile offenders applicable.Therefore,this article on probation through the application of juvenile delinquency are introduced to analyze some of the problems which exist,and put forward some measures and suggestions for improvement of the legislative and judicial practice of the existing problems.
