与人们日常生活甚为密切的市场交易秩序建基在情理社会基础上.情理社会中的伦理情谊关系在一定程度上依然主导着交易主体的行为方式与行动逻辑.焦玉良仅从社会交往形式抑或社会呈现的表层现象就认定中国社会已步入"生人社会"、认为交易主体之间展开的交易行为需要建立在普遍信任基础上的制度承诺的观点过于草率偏激,并陷入新古典经济学的理论陷阱中.认知市场交易秩序,应当关注交易主体行为及其社会交往的社会文化环境,应当在普遍性与特殊性、理性与情理、熟悉与陌生之间理解其本质,并探寻优化之道.从社会整体的脉络看,"伦理情谊之手"和"法治理性之手"均是维系市场交易秩序不可或缺的力量.

The market transaction order which is intimate with social life is based on the reasonable society. The ethical-friendly relationships still control traders' behavior and action logics. Jiao Yuliang be-lieves that Chinese society has stepped forward stranger society, and the transaction behaviors between the traders need the institution promises which are based on the generalized trusts. His perspectives are very sloppy and has been trapped into the theories of new classical economics. We should take cognizance of the market transaction order and the transaction behaviors from the social-cultural environment, and should understand their nature and explore their optimal paths between the universality and speciality, ra-tionality and sensibility, familiarity and defamiliarization."The ethics hand of friendship"and"the hand of the rule of legal reason"are indispensable to maintain the market transaction orders from the perspec-tive of holistic social contexts.
