在肯定《中华人民共和国体育法》(以下简称《体育法》)颁布实施20年来成就的基础上 ,面对现实 ,坚持依法治体的基本方针 ,树立从行政管理法转变为权利保障法的修法理念 ,建议采用修订方式对《体育法》进行修改 ,明确《体育法》的调整对象 ,界定主管部门职责 ,修订基本原则 ,完善体育行政执法 ,调整分则结构 ,对大众体育(群众体育)、学校体育和竞技体育等方面实际的法律概念进行科学规范和梳理 ,明确体育社会团体的法律地位 ,新增体育产业等内容 ,完善法律责任.

After two-decade implementation of the Sports Law of the People's Republic of Chi-na ,we should face the reality ,stick to the principle of rule of law and change the nature of the Sports Law from being an administrative law to a law focusing on rights protection .Firstly the Sports Law should define the targets and responsibilities of the authorities .Secondly ,the Sports Law should modify the General Principles and the sports administrative enforcement of the law and adjust the structure of the Specific Provisions ,standardize legal concepts of mass sports ,school sports and competitive sports and define the legal status of sports organizations . Thirdly ,the sports industry should be stipulated and legal responsibilities should be improved in the Sports Law .
