“院前急救医疗机构”是指专门从事院前急救的公益性卫生机构。对院前急救医疗机构的法律主体地位的界定，应该从有关法律主体的规定和院前急救医疗机构的成立方式等方面入手；院前急救医疗机构在院前急救中与患者形成的是民事法律关系，因医疗救护员的医疗过失行为造成患者损失的，应由其所在的具有独立法人资格的院前急救医疗机构对外承担民事责任；鉴于院前急救工作是一项高强度、高风险的医疗活动，因此应减轻或免除其民事损害赔偿责任。

Pre-hospital emergency medical institutions refers to public health institutions specialized in pre-hospital first aid. We should start from the relevant provisions of legal subject and the establishing way of pre-hospital emergency medical institutions to define legal subject status. Pre-hospital emergency medical institutions and patients form the civil legal relations in pre-hospital first aid. If the damage to the patients is caused by medical rescuers' negligence, the pre-hospital emergency institutions which have the qualifications of independent legal representative shall bear civil liability. Given that the pre-hospital emergency work is a medical activity with high intensity and high risk, its civil liability for damages should be reduced or removed.
