空难受害主体可分为旅客、机组人员和第三人，其精神利益损害的赔偿问题从《华沙公约》到《蒙特利尔公约》都未予以明确规定。不同主体精神损害赔偿范围不一，主要分为两类：因身体伤害引发的精神损害获赔和纯粹精神损害赔偿，前者一般可获赔，而后者由于较难举证与认定，在以往实践中一般不予以赔偿，即使赔偿，在请求主体、赔偿规则与范围上存在诸多限制。但根据罗马公约现代化成果之一的“一般风险条约”中精神损害赔偿部分规定的解读，可知国际航空公约对精神损害赔偿，尤其是纯粹精神损害的赔偿的认可是必然的趋势。

There are three types of victims in air crash: air passengers, flight crew and the third party. Their compensation of mental injury has not been ruled clearly in which from the Warsaw Convention to The Montreal Convention. Different victims have different compensation request. There are two main types:mental injury caused by physical injury and pure mental injury. In general, the former could be supported, while the later would be denied in practice because of the difficulty in putting to the proof and affirmation. Even it was supported, there are many restrictions in claimant, regulation and scope of compensation. But according to the “mental injury” provision of the General Risk Convention, which is the one of the modernized achievement of Rome Convention. According to these explanations , it can be known that the supporting of the mental injury, especial the pure mental injury by the international air convention is an inevitable trend.
