在我国当前大力推进反腐工作的背景之下，对“吃空饷”行为的性质进行深入探讨显得极为必要。“吃空饷”行为总体上包括三大类型：在编在岗吃空饷、在编不在岗吃空饷和不在编不在岗吃空饷。针对其中一部分确属违规违纪的“吃空饷”行为，通过公务员法予以行政处分合情合理。但对于具有严重社会危害性和主观恶性，同时又具备刑事违法性的特定“吃空饷”行为，应当引入刑法评价机制，根据行为的不同表现方式，分别以贪污罪、诈骗罪或受贿罪等追究刑事责任。
在我國噹前大力推進反腐工作的揹景之下，對“喫空餉”行為的性質進行深入探討顯得極為必要。“喫空餉”行為總體上包括三大類型：在編在崗喫空餉、在編不在崗喫空餉和不在編不在崗喫空餉。針對其中一部分確屬違規違紀的“喫空餉”行為，通過公務員法予以行政處分閤情閤理。但對于具有嚴重社會危害性和主觀噁性，同時又具備刑事違法性的特定“喫空餉”行為，應噹引入刑法評價機製，根據行為的不同錶現方式，分彆以貪汙罪、詐騙罪或受賄罪等追究刑事責任。
재아국당전대력추진반부공작적배경지하，대“흘공향”행위적성질진행심입탐토현득겁위필요。“흘공향”행위총체상포괄삼대류형：재편재강흘공향、재편불재강흘공향화불재편불재강흘공향。침대기중일부분학속위규위기적“흘공향”행위，통과공무원법여이행정처분합정합리。단대우구유엄중사회위해성화주관악성，동시우구비형사위법성적특정“흘공향”행위，응당인입형법평개궤제，근거행위적불동표현방식，분별이탐오죄、사편죄혹수회죄등추구형사책임。
Under the current background of China promotes anti-corruption work vigorously,depth discussion on the nature of the act“eat empty rates”is extremely necessary.“Eat empty rates”behavior in general,including the three main types:the series in the post to eat empty rates ,not post in the series to eat empty rates and not in the series nor in the post to eat empty rates.For some of which are indeed violation of discipline“eat empty rates”behavior,administrative sanctions by the Civil Service Law is reasonable.But some specific“eating empty rates”which has serious social harm and subjective vicious,and also has a criminal offense,criminal law evaluation mechanism should be introduced,according to the different manifestations of behavior,it should be respectively held criminally responsible for embezzlement,fraud or bribery and other crimes criminal.
