互联网的日益普及网络游戏的迅速发展导致了网络纠纷的日益增多，尤其是网络游戏虚拟财产侵权案件频频发生，引起了很多的争议；对虚拟财产是否需要保护，以及如何进行法律保护，这些都成为迫切需要解决的法律问题。从虚拟财产刑法保护的可行性和必要性出发，通过分析我国现行刑法对虚拟财产的保护现状，探究如何完善我国网络虚拟财产的刑法保护。

The constant prevalence of internet and the rapid development of internet games leads to a continuously climbing amount of internet disputes,especially the tortuous legal cases of the virtual property in internet games which occur frequently are becoming a rising controversial issue.Whether vir-tual property needs protection and how we protect it by law are all becoming an imperative legislative problem.This paper,beginning with the discussion on the feasibility and necessity of the protection to the virtual property,studies how we can optimize the penal protection for the virtual property in China through analyzing present state in China's penal protection for the virtual property.
