法治是良法之治，有关高等教育的法律应尊重高等教育规律，尊重大学自治。这意味着，有关高等教育的法律不能对高校的所有事务做出规定，高校自主决定其内部事务的权利应该得到尊重和保留。高等教育立法应在对高校办学行为的限制与保护高等学校自治权和高校教师学术自由之间谨慎平衡。

Nomocracy follows the rule of justice law, and laws related to higher education should obey its theorem as well as the autonomy of universities. That means, laws in the fields of higher education cannot stipulate all its affairs. For internal affairs, the autonomous decision right of universities should be respected and retained. Higher education legislation needs to keep balance cautiously between restrictions for school-running and protection of autonomy and academic freedom of colleges and universities.
