在法系国际化的背景下，英美法系和大陆法系两大法系趋于融合，特别是判例与立法互动发展，在金融法领域表现尤为明显。值得注意的是，当代金融法律正处于完善过程当中，国际金融危机成为重要推动因素，相关做法对于我国具有重要启示。主要包括：提高涉案人员的违法成本，发挥法律威慑对于维护金融市场秩序的基础作用；增强市场透明度，打击欺诈行为，完善金融消费者保护机制，改善实际效果；重视监管空白地带的潜在风险，完善中央与地方的监管分工机制，完善工作组层面的监管协同机制；重视完善高风险金融活动的约束规则，并完善风险隔离机制和应急干预机制。

In the legal system under the background of internationalization,the Anglo-American law system and continental law system tend to merge,especially the cases and interaction with the devel-opment of legislation,especially in the field of financial law.It is worth noting that the contemporary financial law is in perfecting process,and the international financial crisis become important driving factor,and relevant practice has important implications for our country,which mainly includes:the first is that to increase the illegal cost of the personnel involved to play a vital role for the basis of maintaining the order of the financial markets.The second is that to enhance market transparency ,to combat fraud and perfect the financial consumer protection mechanism to improve the actual effect;The third is that to emphasize on the potential risk of regulatory gap,to perfect the supervision mecha-nism of division of labor of central and local and to improve level of the working party supervision co-ordination mechanism;The fourth is that to attach great importance to improve the constraint rules of high-risk financial activities and to improve the risk isolation mechanism and emergency intervention mechanism.
