环评乱象丛生使得环评政府信息公开案件不断产生，而司法裁判文书是勾勒环评政府信息公开实践面相及司法现状的重要载体。通过对司法裁判文书的分析可以发现，法院在审判中过于依赖环保行政机关的判断，加重了原告的举证责任。因此，法院不但应提高环评政府信息公开案件的审查力度，同时也应对环保行政机关是否为信息公开义务机关及信息公开豁免理由等举证责任进行实质审查。

The chaotic environmental impact assessment results in constant occurences about EIA government information publicity, and the referee documents are important carriers to outline the EIA government information disclosure and to reveal the judicial status quo. Through the analysis of judicial documents, it can be found that the court relies too much on the environmental protection department of judgment during the trial, hence increasing the plaintiff's burden of proof. Therefore, the court should enhance the scrutiny of EIA cases of government information disclosure to strengthen the burden of proof for open cases, and should at the same time conduct essential censoring of proof duties including whether the administrative organization bears disclosure obligations and whether information disclosure enjoys exemption reasons.
