生态损害是环境危害行为对生态环境良好生态服务功能造成的损害。生态恢复是生态损害赔偿的主要目标。我国目前的生态损害赔偿在“损害主体认定、损害程度计量、损害赔偿兑现”等方面体现出巨大的制度需求。根据制度经济学的制度需求与供给理论，我们需要从健全环境基准制度、完善生态损害评估制度、创新生态损害赔偿方式、规范生态恢复性司法等方面为生态损害赔偿提供及时有效的制度供给。

생태손해시배경위해행위대생태배경량호생태복무공능조성적손해。생태회복시생태손해배상적주요목표。아국목전적생태손해배상재“손해주체인정、손해정도계량、손해배상태현”등방면체현출거대적제도수구。근거제도경제학적제도수구여공급이론，아문수요종건전배경기준제도、완선생태손해평고제도、창신생태손해배상방식、규범생태회복성사법등방면위생태손해배상제공급시유효적제도공급。
The ecological damage is the damage to the good ecological function of the ecological environ-ment which is caused by the harmful behavior to the environment.Restoration of damaged ecosystem is the main target of the compensation for ecological damages.The current compensation of environmental damages reflects huge institutional demands in many aspects,such as identifying damage subject,metering the extent of damage and cashing the compensation.According to the institutional demand and supply theory of institutional econom-ics,we should provide timely and effective system supplies for ecological damage compensation,including im-proving the environmental standard system,improving the assessment system of ecological damage,innovating the way of ecological damage compensation,and regulating the justice of ecological restoration.
