最高人民法院最新颁布的《关于扣押与拍卖船舶适用法律若干问题的规定》规定船舶活扣押将不再受海诉法调整而改为适用民事诉讼法有关规定.活扣押在适用条件、管辖法院、担保方式等方面都将面临新的转变.但这种转变并不成熟,以一般法调整具有特殊性的船舶扣押问题是否适宜值得商讨.最好的办法是像对待死扣押一般制定专门的条款明确其操作程序,促进船舶保全措施的多样化发展.

The latest regulations issues by the Supreme People's Court about a number of problems of the applicable law of the arrest and auction of ship required that the live detention of the ship will no longer be subjected to maritime procedure law and instead in the relevant provisions of civil procedure law. New changes will occurred in the application conditions、jurisdiction and security. But this change is not mature, the general law to adjust the special issue whether appropriate is worth discussing. The best way is to develop special provisions like the detention of ship to promote the diversification of the ship' s security measures.
