行政审判权是司法审判权的重要组成部分.对已往20余年行政审判权运行实效的准确评估,是我们厘清行政诉讼—这一行政权与司法权交互纠缠领域—真实情境的主要依据,也是我们在权力结构中重新定位行政诉讼制度价值追求与方法,乃至重塑制度的重要凭据.本文试图通过对《行政诉讼法》颁布实施以来,20余年行政审判各项数据进行归纳,在对比分析的基础上,得出一些局部判断,以期探寻行政司法演进的规律和行政司法变革的方向.

Administrative jurisdiction is an important part of judicial jurisdiction.The accurate assessment on the operating effectiveness of administrative jurisdiction in the past two decades is the main basis for us to clarify the real situation of the administrative proceedings in which executive power and judicial power interact each other,also the important basis for us to redefine worth pursuing and methods of administrative proceeding system in the power structure,even remodel the system.This paper attempts to summarize the data about twenty years of administrative trials since the adoption of Administrative Procedure Law, draws some partial judgment on the basis of comparative analysis,in order to explore the rules of administrative judicial evolution and the direction of administrative judicial reform.
