生态文明是人类社会为了应对生态环境危机而产生的一种新型文明形态 ,其核心目标在于实现人与自然的和谐共处.生态文明建设离不开法律的保驾护航 ,其中作为国家根本大法的宪法所提供的保障 ,构成了整个生态文明法律保障体系的基础.但是 ,我国现行宪法在制定和修改之时 ,都没真正涉及到生态文明 ,从而使其建设缺乏 "高级法" 的依据与保障.为了促进生态文明建设的顺利展开 ,今后我国在修宪时 ,应当做到如下几点 :第一 ,生态文明入宪 ;第二 ,环境权入宪 ;第三 ,完善宪法生态环境保护条款.

Ecological civilization is a new civilization form of human society to deal with the crisis of ecological environment , whose core objective is to realize the harmonious coexistence between human and nature . The ecological civilization construction will not actually work without the protection from law , and the constitutional safeguard has constituted the foundation of the entire ecological civilization legal protection system . However , China's constitution is not really concerned about ecological civilization when it is formulated or revised , which causes the ecological civilization construction without base and protection from the "higher law" . In order to promote the construction of ecological civilization to go well ,we should do as follows when the China's constitution is revised in the future:firstly , ecological civilization is written into the constitution;secondly , environmental right is written into constitution;thirdly , the constitutional provisions about ecological environment protection are improved .
