在村庄内部的征地补偿分配纠纷中，矛盾的焦点是“外来户”是否应该获得征地补偿，其实质在于外来户是否享有村组集体成员权。对此，外来户和本地户的认知直接冲突。外来户以户籍和土地承包经营权为集体成员权的基础，主张法定权益应当受到保障，他们为获得村庄内部的认可做出了多种努力。本地户对集体成员权的认定，主要以“祖业”观念和集体化时代的劳动付出为依据，是传统观念和集体主义观念结合的产物。外来户的主张有国家法律制度的支持，本地户的认知却在地方社会实践中处于竞胜地位。外来户问题及集体成员权认知冲突的意涵，在国家治理转型背景中可以得到完整理解。

Among the dispute of compensation distribution on land expropriation, the ultimate focus of this collision lies in whether or not the outsiders, which referred to families transferring from other places, pos-sesses the right to receive land expropriation compensation.The essence of this collision is to discuss the out-sider’s collective member right in a certain village.In this issue, the outsiders and local people are faced with a cognitive conflict directly.Indeed, the outsiders base collective member right on both of their domiciliary register and rural land contractual management right, claiming their legal interests should be protected.In re-ality, they have made a tremendous variety of efforts to get the approval of the village.In the aspect of recog-nizing collective member right, patrimonial estate as well as the efforts made in collectivization times are the significant standards, which expressly show the influence of traditional viewpoints and collectivism idea.The outsiders insist on supporting the relative law, nevertheless the locals claim that the specific social practices is superior.The connotation of the outsiders as well as collective member right could be comprehensively under-stood in national governance transition.
