信息技术在刑事诉讼中的应用，使得公正与效率两大诉讼价值更好的实现，2012年新刑事诉讼法中规定了同步录音录像制度，意图用科学技术的力量避免刑讯逼供的出现。但是在实践中出现了法律没有明确规定的问题，即讯问时同步录音录像资料的法律性质问题。按照域外法律规定，同步录音录像具有证据的属性，应当适用证明规则的规制。但是中国司法实践中，考虑到侦查技术和侦查秘密的问题，许多人并不愿意将同步录音录像作为证据使用并公开。在作为证据的同步录音录像和侦查秘密之间找到一种缓冲手段，成为本文的核心所在。

The application of Information Technology in criminal proceedings highlights the justice and efficiency of the litigation. In 2012, the new criminal procedural law stipulated the synchronous audio and video recording system, which tends to avoid the occurrence of torture with the power of science and technology. But in practice, there is no specific provision in the law, that is to say, there is no way to determine the legal nature of the synchronous video recording data. According to the foreign legal provision, the synchronous audio and video recording has the property of evidence. However, in China's judicial practice, considering the problem of investigation techniques and their secret, many people are reluctant to use them publicly. So it might as well find something between the nature of evidence and secrets of the synchronous audio and video recordings, which is the core of this article.
