科技的竞争本质上就是人才的竞争,如何培养国际型、应用型及复合型的卓越知识产权法律职业人才是我国当前法学教育中一个重大的理论和实践课题。然而,我国高校对知识产权法学教育战略定位及教育理念存在一定的认知偏颇,加之传统的知识产权法学教学手段与方法单一等原因,导致卓越知识产权法律人才的培养目标和价值未能得以充分彰显。法学教育改革中,难度最大的部分乃是课堂教学方法的改革。教师应统筹协调知识产权法学的授课内容,为学生架起连接国际法与国内法的桥梁;灵活运用“苏格拉底教学法”,积极引入“头脑风暴法”,最大限度地激发学生的创造性思维,以期培养和造就卓越的知识产权法律职业人才。

The scientific and technological competition is essentially the talent competition. Our legal edu-cation is contemporarily confronted with how to develop excellent intellectual property legal occupational talents who are internationally applied and interdisciplinary, which is a significantly and urgently theoretical and practi-cal project. Many universities in China hold a cognitive bias against intellectual property legal education strate-gic orientation and educational philosophy, in addition to the traditionally single and unenlightening teaching method, which has resulted in the fact that the intellectual property legal talent training goal and its value has not been fully manifested. Among legal education reforms, the most difficult part is the reform of classroom teaching methods. Teachers should coordinate the teaching content so as to set up a bridge for students connect-ing domestic and international intellectual property law. At the same time, teachers are supposed to make flexi-ble use of “Socratic method” and actively introduce “brainstorming” to furthest stimulate students’ creative thinking, so that we are able to develop and bring up excellent intellectual property legal professional talents.
